Mile high club? Indictment alleges sex on plane

RALEIGH, North Carolina (AP) -- A California couple are facing federal charges after allegedly refusing to stop "overt sexual activity" on a flight to Raleigh, North Carolina.

Carl Warren Persing, of Lakewood, California, and Dawn Elizabeth Sewell, of Huntington Beach, California, were indicted on charges of interfering with flight crew members during their September 15 Southwest Airlines flight from Los Angeles.

According to court documents, flight attendants saw Persing and Sewell kissing, embracing and "acting in a manner that made other passengers uncomfortable" while the plane was stopped in Phoenix.

A flight attendant asked them to stop. They obeyed initially but resumed the behavior during the flight from Phoenix to Raleigh, authorities said.

When the flight attendant again requested them to stop, Persing allegedly told the flight attendant: "I'm going to give you one warning to get out of my face."

Persing and Sewell continued the verbal harassment after a flight attendant refused to serve Persing alcohol, according to court documents.

Law enforcement officials were waiting for the couple when they arrived at Raleigh-Durham International Airport. Messages left for Persing and Sewell's attorneys were not returned.

Public Affection is one thing, but when you're doing things that are making other people uncomfortable. That's a different story. Some people simply have no cooth.

Why didn't they just take it to the bathroom??? lol

RALEIGH, N.C. -- The attorney for a California man who's accused of what authorities call "overt sexual activity" on a flight to Raleigh said his client actually just wasn't feeling well.

Raleigh lawyer Deb Newton said Carl Warren Persing laid his head on his girlfriend's lap because he was drowsy -- a gesture Newton says was misinterpreted by a flight attendant. She said the attendant then humiliated and harassed the couple.

Newton said the one witness she talked to disputes almost everything in the government's affidavit, as does Persing. She expects the charges will be dismissed.

RALEIGH, North Carolina (AP) -- A man arrested for allegedly engaging in "overt sexual activity" with his girlfriend on an airliner was lying with his head on her lap because he wasn't feeling well, his attorney said.

She said Persing suffers from a chronic disease requiring medication that makes him drowsy, dizzy and irritable. She would not identify the disease to protect her client's privacy.
