Woman accused of smothering infant fails to get required treatment
The North Creek woman who police said accidentally smothered and killed her infant son last winter was sent to Warren County Jail for up to a year Wednesday after she admitted violating her probation.
Amy E. Campbell chose not to fight allegations she violated her probation by having alcohol at her home and not getting substance abuse treatment as required. Judge John Hall terminated her probation when sentencing her to the jail term.
Instead of pursuing the substance abuse treatment, Campbell accepted the maximum punishment that could be imposed for her conviction on a misdemeanor charge of endangering the welfare of a child.
"The tragedy of this case is, she was given every opportunity by the criminal justice system to get help for the underlying issue in this case, which is alcohol and drug abuse," said Warren County District Attorney Kate Hogan. "She has showed no indication she is willing to change."
Those sentenced to a year in jail have to serve at least 8 months before becoming eligible for release. They can get up to 4 months off the full sentence if they behave.
Campbell, 33, served 115 days in jail while awaiting disposition of the charges and after being charged with violating probation, and will have to serve at least 129 days more before becoming eligible for release, Warren County Sheriff Larry Cleveland.
"Her release date will be May 11, with credit for good behavior," he said.
In October, she was put on probation for 3 years after pleading guilty to endangering the welfare of a child, a misdemeanor, in the Feb. 2 death of her 7-week-old son, Dominic Marseglia. She was accused of smothering him as they slept together in her bed, after Campbell took prescription drugs and drank beer despite warnings not to mix the two.
Her guilty plea came after manslaughter and criminally negligent homicide charges that were filed against her were dropped because autopsies could not determine the cause or manner of the boy's death.
When appearing in court last month, Campbell told Hall she expected to get 6 months in jail for the violations. She did not speak during Wednesday's proceeding other than to say something to the effect that she had "learned to keep my mouth shut."
Campbell was represented by the Warren County Public Defender's Office. Public Defender John Wappett could not be reached for comment Thursday.
