A 23-year-old soldier recently back from Iraq is being accused of repeatedly shaking his 7-month-old son.
Brian Benoit was arraigned in Troy City Court Friday morning. He's charged with assault, reckless endangerment and endangering the welfare of a child.
The baby is being treated for head trauma at Albany Medical Center.
Police say Benoit is assigned to an Army Reserve transportation company out of Pittsfield, Mass. and is home on leave from his duty in Iraq.
If convicted on the assault charge he’ll face up to 25 years in prison.
An awful story, but I am willing to bet anything he pleads Temporary Insanity, due to PTSD and gets off.

Yep. And depending on what his job over there specifically was, he could easily get off.

my cousins son was collicky or however the hell you spell it. im not saying its acceptable, but when your around a child who will not stop crying no matter what you try to do, i can understand how people go a little insane from it.

My dads the one who arrested the guy. I cant imagine what was going through his head with a guy being there for almost killing his infant son. Im glad I dont have his job. :sad:

I don't see the correlation between the guy being in Iraq and beating the shit out of his infant son. I'm sure it had to do more with the fact that he doesn't know how to be a good enough parent to quiet the kid down through normal care of a child so he turned to violence to attempt to make the kid understand he doesn't like that he's crying.

I don't see the correlation between the guy being in Iraq and beating the shit out of his infant son. I'm sure it had to do more with the fact that he doesn't know how to be a good enough parent to quiet the kid down through normal care of a child so he turned to violence to attempt to make the kid understand he doesn't like that he's crying.
It worked when he had to shutup the towelheads.

It very well may have, and Im sure thats the case, BUT due to the fact that he just came home from a war zone, there is no doubt in my mind that his lawyer is going to argue that he was suffering from Post Traumatic Stress Disorder, and that had something to do with why he reacted the way he did.
Either way you look at it, he is a shitbag.
