(Albany, NY - AP) — The state's highest court has ruled against a New York City man claiming self-defense when he killed another man during a confrontation in a doorway.

The Court of Appeals unanimously ruled the doorway to an apartment can't be considered part of that person's home.

That argument was being used by Richard Aiken, who's appealing his conviction for killing Theodore Badgett in December 1999 in their Bronx apartment building.

The two men had a history of run-ins, and Badgett had stabbed Aiken in an earlier dispute.

In the 1999 confrontation, Badgett confronted Aiken as Aiken stood in his doorway. Aiken hit Badgett in the head with a lead pipe, killing him. Aiken said he feared for his life.

During his trial, Aiken argued that New York law says a person doesn't have to retreat from a threat if he's in his own home.

But the Court of Appeals says an apartment doorway is a hybrid private-public space in which a person doesn't have the same reasonable expectation of seclusion as in a home.

On a related note: If I see anyone on my property at all that looks like they're trying to hurt me or my family, I'll kill them on sight. I don't give a fuck where they're technically standing.

Gee. This makes perfect sense. Someone's coming into your house to threaten you or your family... they're only in the doorway (which you would be in if you were trying to get into the house) so you can't do anything, since the danger has technically not started yet...

Much better idea to wait til carnage occurs and then try to do something... yes... that makes sense.

Edit: and I agree with you Bill... that's the way it should be.

i believe even if he is in your home, its equall or lesser force. like for instance, if he has a knife you cant shoot him, you have to go find a knife before you defend yourself.

I think you're partially right, Tro.

But I think that if you feel that your LIFE is threatened... like be it that the person has a knife or a gun, you can use appropriate action. If someone comes in unarmed, and you aren't in as clear of a state of danger, I think you can't kill em.

I dunno though, I'm with Bill... I'd kill the motherfucker on sight.
