A man who secretly set up a home video camera to film his wife in the bath avoided a jail sentence yesterday.

Magistrates at Yate, near Bristol, were told the 55-year-old husband had linked the bathroom camera to a television in the couple's bedroom for "sexual gratification".

His wife unwittingly discovered the camera, installed in the ceiling, after she turned on the television and saw her naked husband in the bath, said Jan Fish, prosecuting.

After confronting her husband about the camera, she left the house. On her return, she found a recorded confession in which her husband admitted setting up the camera to watch her in the bath. She called the police and her husband was arrested.

The man told police he had purchased and installed a closed circuit television camera in the bathroom. Mrs Fish said: "His reason for doing this was for watching his wife in the bath and he had planned to watch them together in the bath for their sexual gratification."

The man, who pleaded guilty to three counts of voyeurism, was sentenced to a nine-month community rehabilitation order.

Debbie Bakehouse, defending, said the wife had thrown her husband out of the home they shared in a village in South Gloucestershire and was now filing for divorce.

"He understands he should have got his wife's consent before this took place."

The man was ordered to pay £130 costs and an order was made to destroy the surveillance and recording equipment. The offence of voyeurism entered English law in the 2003 Sexual Offences Act. The man cannot be named to protect his wife's identity.
