Motion: Alleged victim, an admitted porn addict, has 21-year-old, live-in girlfriend

SALISBURY -- Defense counsel for the 41-year-old Salisbury Christian School music teacher arrested and charged with multiple sex offenses has filed a motion to dismiss the case based on the vagueness of allegations and maturity of the victim.
Carole Leigh Mayers, an Eden resident, has been charged with 16 offenses including sexual abuse of a minor, third- and fourth-degree sex offenses and showing obscene matter to a minor after the Wicomico County Child Advocacy Center was informed of the alleged sexual relationship between Mayers and a male student.
The alleged sexual affair between Mayers and the teen took place between May 2006 and December 2007, according to court documents. The victim told investigators he and Mayers had sex about 25 times, and said Mayers allegedly sent the student nude pictures of herself, according to court documents.
Mayers was held and released from the Wicomico County Detention Center on Nov. 19. She was indicted by a grand jury in December. A Wicomico County Circuit Court hearing is scheduled Friday for Mayers.
The motion asks the court to dismiss the case based on the "vague and uncertain dates of offenses for each charge."
The motion also argues that the victim, now 17 years old, is mature based on a number of factors including the fact that he has a 21-year-old girlfriend who he has had an ongoing sexual relationship with for more than two years.
His girlfriend, according to the court document, lives with him and his mother.
The motion goes on to state that the victim, before he dropped out of school, publicly admitted to being voluntarily sexually active and using illegal drugs since he was 12 years old.
It also states the victim has admitted to being a pornography addict.
A Harford County assistant state's attorney, Bruce M. Smith, was selected to prosecute the case on behalf of the state after the Wicomico County state's attorney, Davis Ruark, declined to prosecute the case to avoid a conflict of interest.
Former Wicomico County state's attorney Andrew M. MacDonald is representing Mayers.
