Bar owners argue smoking ban is too vague

Group says enforcement varies from county to county

ALBANY, Feb. 24

Restaurant and bar owners went to Federal Court in Albany Thursday to attack the state's ban smoking on smoking in workplaces.

Part of the current law allows a waiver if a business can show it has suffered hardship.

But the tavern owners complain some counties are rejecting all applications. The group wants a more uniform system.

“And the fact that we have 62 counties, 37 different enforcement jurisdictions and they all have different rules demonstrates to us that this law is vague,” said Scott Wexler of the Empire State Restaurant and Tavern Association.

If a judge agrees with the Tavern Association's lawsuit, it is possible the state smoking ban in restaurants and bars could be set aside. However, it is also possible no change will be made.

A ruling is expected in a couple of weeks.

I think it's alot safer that they can't smoke in the dance clubs anymore, I always hated being on the dance floor with some drunk ass person smoking a cigarette and not paying attention to what they were doing.

I think it should be ok to smoke in bars though.

Smoking created a certain atmosphere in a bar or club that I got accustomed to. I don't care for the clean air in there anymore. And I'm not a smoker.

I further believe that bars aren't hurting for business. Quit your fucking crying. It's not like one bar voluntarily prohibits smoking, it's a statewide ban. You don't like it, get the fuck out of New York. Asking your county to give you a waiver gives you an unfair advantage against other bars in the smokers' demographic, so how fair is that?

it took a while to get used to, but after i was there for a while i grew to really like it. it was a nice place to live.

Once the NY ban was in place and I was in DC, I didn't care for the smoke any longer. Smoke makes me sick. One reason it seemed like it took an eternity for you and Shannon to get to Dan's place on Saturday. In a little apartment with 4 smokers. Not pleasant.

technically mindy, if it has a roof over it you can not smoke under it. even if its just an awning. you can only legally smoke in a totally unenclosed area.

I got used to the ban while we were living in NYC. So when it became illegal to smoke up here, I was already prepared. When we went out to dinner in DC, I was like Oh shit, I can smoke a stog with this corona!!!
edit: we drove through maryland on the way to VA.
