Prosecutors say a Glens Falls man nearly killed a 3-year-old boy when he held the child under water.
Little Noah Rich was taken to Glens Falls Hospital. His mother's boyfriend, 31-year-old Dennis Brill, is accused of putting him there.
There was no answer Wednesday afternoon at the Glens Falls apartment where Noah nearly drowned.
Police say Brill held his girlfriend's son underwater in the bath tub at around 10 p.m. Tuesday.
Brill lives in the apartment with his girlfriend, Laura Rich, and her two sons.
“We know he's been living at 191 Warren Street for about 30 days with his live-in girlfriend. She went shopping and left him in charge of 3-year-old and 9-year-old children,” explained Glens Falls Police Chief Joseph Bethel.
The mother told police she came home and found her son lying naked on a table and he was lifeless.
Police say Brill, who is an echocardiogram technician, performed CPR on the boy.
Brill has been charged with two counts of assault and endangering the welfare of a child.
Authorities say the 9-year-old witnessed the attack.
Warren County District Attorney Kate Hogan says Brill could face more charges.
“Everyone who is a parent understands that children can frustrate you, but you can never, ever understand the conduct that is alleged in this case. I have three children of my own and I know what it's like to parent a child and it can be difficult. Cases like this just are mind-boggling,” Hogan said.
Police say they believe Brill was upset with the boy for soiling his pants.
